Does the seller HAVE to Fix what is on the Buyers Home Inspection Report?

A question that I often get asked when selling a Milpitas, CA home is about the buyers home inspection results and who is responsible to pay for the suggested repairs, typically a home inspector will prepare a home inspection report for the buyer with a list of items that the home inspector suggests to be corrected or another term they use is "findings".

So the question is, does the Milpitas, CA. home seller need to or does the seller have to fix anything on the buyers home inspection report?

A simple answer to the question is that it really comes down to 2 main factors

  1. Is it a Safety or Health "finding" or issue
  2. Is it Cosmetic "finding" or issue

What is a health or safety home inspection finding? Some examples of safety or health issues might be anything from traces of possible mold findings, broken heaters or furnaces, missing smoke detectors, etc..etc..
Generally when a home seller is considering selling the home he or she has to make sure that the home is livable at a descent comfortable and secured level for the potential new home buyer.  

What is a cosmetic finding? Some examples of cosmetic findings might be, old carpet, dated counter tops or kitchen cabinets, paint, tile floors, etc...etc...
Everyone has a different style and opinion on what looks good. What looks good to the home seller might not look good to the home buyer. 

When the potential buyers home inspector inspects the sellers home he or she will most likely and should be inspecting the entire home from the top of the roof, to underneath the home and everything in between. Once the buyers home inspector completes his thorough inspection, (which usually takes anywhere from 1-3 hours depending on the size of the home) he will then in turn share the results or findings in a report compiled for the buyer usually within 12 to 24 hours.

Depending on the condition of the sellers home, the buyers home inspection report might show either a combination of  health and safety findings along with cosmetic findings, or no findings at all. 

Here's where you want to know if you should fix any of the safety or health findings right? Well if it's a hazardous health and safety issue it is recommended that it's fixed right away, but you might also be able to negotiate the repair cost with the buyer or better yet, (depending if you're represented by a qualified Real Estate Agent) you might not have to pay for any repairs at all.
